Miller Trust Guide

About

I'm James Whitfield. I built this site because the free state-published Miller Trust templates explain the form fields and stop there. The parts that actually stall families — opening the bank account, funding the trust inside the right calendar month, avoiding the paperwork mistakes that get applications sent back — are spread across policy manuals most people never see. An elder-law attorney typically charges $1,000–$2,500 to handle it. Between the policy manual, the bank counter, and the Medicaid application window, there is a real gap most families get stuck in. This site fills that gap.

I'm not an attorney. I'm a researcher who has now read every state Medicaid policy manual section that covers Qualified Income Trusts. I publish what I learned — the operational steps, the bank-account walkthroughs, the common denial reasons, the exact policy citations. I will not advise you on your specific situation; for that, you need a licensed elder-law attorney in your state. The state bar in your state has a referral service for low-cost initial consultations.

The state agency manuals are the authority; my job is to translate them, with a citation on every claim.
